Personal Injury

“Personal Injury” is a generic term that encompasses many different types cases and causes of action.  Each injury and each case are different, but every case centers around the concept of legal duty.  Both state and federal law impose on each of us, various legal duties.  Different duties arise in various situations and many legal duties are very specific to the type of activity or conduct involved in.

Generally the law requires each of us to act as a reasonable and prudent person would act under the same or similar circumstances.  This means that each of us owes everyone around us the duty to exercise ordinary care and the duty to avoid conduct that places the people around us at risk of physical or financial injury.  When we drive we owe a duty to those around us to drive with ordinary care.

The same general rule of ordinary care applies to physicians, contractors, police officers, lawyers, corporations.  If you have been physically or financially injured because someone or some corporation failed to exercise ordinary care you may have a legal claim against them.
