WRONGFUL DEATH

In the State of Texas, if an individual is killed as a result of the negligence or other wrongful conduct of another, the surviving family members may have a right to assert what is known as a wrongful death claim. A wrongful death claim can only be asserted by the spouse, children, or parents of the deceased. It cannot be asserted by siblings. A wrongful death claim allows the spouse, children and parents of the deceased to assert a claim for the loss of love and affection and financial support.
