WRONGFUL DEATH

In the State of Texas, if an individual is killed as a result of the negligence or other wrongful conduct of another, the surviving family members may have a right to assert what is known as a wrongful death claim. A wrongful death claim can only be asserted by the spouse, children, or parents of the deceased. It cannot be asserted by siblings. A wrongful death claim allows the spouse, children and parents of the deceased to assert a claim for the loss of love and affection and financial support.

Like car wrecks and other personal injury claims, one must still establish the liability or fault of the other party and there must be a viable source of recovery.
